INFORMAZIONI GENERALI

Le presenti Condizioni Generali di Vendita hanno per oggetto l’acquisto di prodotti commercializzati da Nous Art Gallery, Toscana Art Connection s.r.l. effettuato a distanza tramite rete telematica sul sito internet www.nousartgallery.it, con sede a San Gimignano (SI), Via Cellolese, 3/d. Ogni operazione di acquisto sarà regolata dalle disposizioni di cui al DLgs. 185/99, DLgs. 206/05; le informazioni dirette alla conclusione del contratto saranno sottoposte all’art. 12 del DLgs. 70/03 e, per quanto concerne la tutela della riservatezza, sarà sottoposta alla normativa di cui al DLgs. 196/03.

CONCLUSIONE DEL CONTRATTO E ACCETTAZIONE DELLE CONDIZIONI GENERALI DI VENDITA
I contratti di vendita dei prodotti sul sito www.nousartgallery.it, si considerano conclusi al momento in cui perviene l’ordine di acquisto effettuato dal cliente a Toscana Art Connection s.r.l. e quest’ultimo lo accetta.Toscana Art Connection s.r.l. invierà tempestivamente al cliente ricevuta dell’ordine di acquisto effettuato dal cliente.
Il cliente, con l’invio telematico del proprio ordine d’acquisto, dichiara di aver preso visione e di aver accettato le presenti condizioni generali di contratto e si obbliga ad osservarle e rispettarle nei suoi rapporti con Toscana Art Connection s.r.l. .

TRATTAMENTO DEI DATI PERSONALI
Toscana Art Connection s.r.l. ai sensi dell’art. 13 del DLgs 196/2003 informa che i dati personali anagrafici e fiscali acquisiti anche verbalmente in riferimento ai rapporti commerciali instaurati, forniti direttamente dagli interessati, ovvero diversamente acquisiti nell’ambito dell’attività della società, saranno oggetto di trattamento nel rispetto della normativa richiamata, compresi gli obblighi di riservatezza da questi previsti.
In relazione ai predetti potranno essere esercitati i diritti di cui all’articolo 7 DLgs. 196/2003.

OBBLIGHI DEL CLIENTE
Il Cliente è tenuto, prima di inoltrare il proprio ordine d’acquisto, a leggere accuratamente le presenti condizioni generali di vendita. L’inoltro dell’ordine di acquisto implica la loro integrale conoscenza e la loro accettazione.
Il Cliente è tenuto, infine, una volta conclusa la procedura d’acquisto on-line, a stampare e conservare le presenti condizioni generali di vendita, già visionate ed accettate durante la fase di conclusione del contratto.

DEFINIZIONE DELL’ORDINE
Con l’invio dell’ordine on-line, il Cliente trasmette a Toscana Art Connection s.r.l. una proposta di acquisto del prodotto e/o dei prodotti inseriti nel carrello. Quando il Cliente effettua un ordine on-line per i prodotti che ha inserito nel carrello, accetta di acquistarli al prezzo e ai termini indicati nelle presenti Condizioni Generali di Vendita.

Toscana Art Connection s.r.l. comunicherà al Cliente l’ accettazione e la conferma dell’ordine.
In particolareToscana Art Connection s.r.l. non accetterà ordini:
– se il materiale, al momento dell’ordine non fosse disponibile a magazzino e/o
– se il Cliente non può o non vuole pagare utilizzando carte di credito (Paypal) o bonifico bancario.
È possibile effettuare un ordine sia tramite il sito www.nousartgallery.it ai prezzi e alle condizioni riportate nello stesso e sia presso le sedi Nous Art Gallery.

MODALITA’ D’ ACQUISTO
Il cliente acquista il prodotto, le cui caratteristiche sono illustrate on-line nelle relative schede descrittive e tecniche, al prezzo ivi indicato a cui si aggiungono le spese di consegna precisate sul sito. (sono escluse le eventuali spese per il pagamento in contrassegno).
Prima dell’inoltro dell’ordine di acquisto viene riepilogato il costo unitario di ogni prodotto prescelto, il costo complessivo in caso di acquisto di più prodotti e le relative spese di consegna.
Una volta inoltrato l’ordine di acquisto, il cliente riceverà da Toscana Art Connection s.r.l. un messaggio di posta elettronica attestante conferma di avvenuta ricezione dell’ordine di acquisto e contenente le informazioni relative alle caratteristiche principali del bene acquistato, l’indicazione dettagliata del prezzo, dei costi di consegna, dei tributi applicabili e dei mezzi di pagamento e contenente un rinvio alle condizioni generali di contratto e alle informazioni circa l’esistenza del diritto di recesso, alle condizioni e alle modalità del suo esercizio visualizzate sul sito. A seguito dell’approvazione del Decreto Legge 4 luglio 2006 n. 223 “manovra bis” Art. 37 commi 8 e 9, convertito con la Legge 248 del 4 agosto 2006, entrata in vigore il 12 agosto 2006, con cui viene ripristinato l’obbligo di comunicazione dell’elenco clienti e fornitori in caso di emissione fattura, e del Decreto Legge 78 del 31 maggio 2010 convertito in Legge 122 del 30 luglio 2010, impone la necessità di richiedere ai clienti di comunicare PARTITA IVA e CODICE FISCALE negli appositi campi presenti sul sito.

PAGAMENTO
Il cliente può effettuare il pagamento dovuto scegliendo una fra le seguenti modalità elencate.

Pagamento con carta di credito: Nel caso in cui il consumatore intenda effettuare il pagamento tramite carta di credito, egli può avvalersi della procedura di pagamento con PayPal, idonea ad assicurare la riservatezza dei dati forniti dai clienti. Per ogni informazione e ulteriori Accordi Legali si rimanda il Cliente a consultare il sito www.paypal.com. Si accettano inoltre pagamenti con bonifico bancario.

CONSEGNA DEI PRODOTTI
Il bene acquistato, unitamente alla relativa fattura, è consegnato tramite corriere all’indirizzo specificato dal Cliente al momento dell’ordine on-line. Eventuali esigenze specifiche dovranno essere prospettate dal cliente a Toscana Art Connection s.r.l.
Toscana Art Connection s.r.l. garantisce la consegna del bene entro 15 (quindici) giorni lavorativi a partire dalla data di ricezione della conferma dell’ avvenuta transazione. (Per il pagamento tramite contrassegno i 20gg saranno conteggiati dalla data di ricezione dell’ordine via e-mail.). Nel caso in cui il cliente scelga la modalità di consegna in contrassegno, il pagamento va effettuato esclusivamente attraverso denaro contante o assegno circolare, da consegnare direttamente al corriere all’atto di ricevimento del bene.
Qualora Toscana Art Connection s.r.l., non riuscisse a garantire la consegna nei termini suddetti, verrà applicato un ulteriore sconto del 10% sul costo complessivo degli articoli curati da Toscana Art Connection s.r.l. di riferimento.
Nel caso di mancato recapito per assenza del destinatario, all’indirizzo da lui indicato nell’ordine, il corriere lascerà un avviso e riproverà una seconda volta; se il destinatario risultasse ancora assente, la merce verrà riconsegnata al mittente.

GARANZIA DI CONFORMITA’
I prodotti acquistati sul sito www.nousartgallery.it sono soggetti alla disciplina sulla vendita dei beni di consumo. I prodotti consegnati sono conformi alle caratteristiche illustrate on-line nelle relative schede descrittive e tecniche.

DIRITTO DI RECESSO
Il consumatore ha diritto di esercitare il diritto di recesso. In particolare, il consumatore ha diritto di recedere da qualunque contratto concluso con Toscana Art Connection s.r.l., senza alcuna penalità e senza specificarne il motivo, entro il termine di 14 (quattordici) giorni lavorativi decorrenti dal ricevimento del bene.
Il diritto di recesso è riconosciuto in capo al consumatore in relazione a qualsiasi bene da lui acquistato sul sito www.nousartgallery.it.

MODALITA’ PER L’ESERCIZIO DEL DIRITTO DI RECESSO
Il diritto di recesso si esercita con l’invio, entro il suddetto termine, di una comunicazione scritta all’indirizzo della Toscana Art Connection s.r.l. mediante lettera raccomandata con avviso di ricevimento.
In caso di esercizio del diritto di recesso, la comunicazione va effettuata al seguente indirizzo:

Qualora sia avvenuta la consegna del bene, il cliente è tenuto a restituirlo a Toscana Art Connection s.r.l. entro il termine di 15 (quindici) giorni lavorativi decorrenti dalla data di consegna del bene.
Il bene va restituito a Toscana Art Connection s.r.l. completo di ogni accessorio, dei manuali di istruzione e di tutto quanto in origine consegnato al cliente, nonché imballato nei suoi involucri originali. Al prodotto restituito va unita una copia della ricevuta elettronica dell’ordine. Le spese di restituzione del bene a Toscana Art Connection s.r.l. sono a carico del cliente.
Se il diritto di recesso è esercitato dal cliente conformemente alle disposizioni contenute nella presente clausola, Toscana Art Connection s.r.l. è tenuta al rimborso delle somme versate dal cliente.
In particolare, Toscana Art Connection s.r.l. procederà gratuitamente alla trasmissione dell’ordine di riaccredito relativo al costo del bene spedito comprensivo delle spese di spedizione entro 30 (trenta) giorni dalla data in cui è venuta a conoscenza dell’esercizio del diritto di recesso da parte del cliente. Questa operazione verrà effettuata tramite l’istituto di credito di emissione della carta di credito utilizzata per il pagamento ovvero accreditando la somma sul conto corrente bancario indicato dal cliente.
Toscana Art Connection s.r.l. ha il diritto di respingere qualsiasi prodotto restituito con modalità diverse da quelle sopra specificate, così come i prodotti per i quali non siano state integralmente pagate dal cliente le spese di restituzione, oppure non siano state rispettate le modalità e i tempi indicati per la comunicazione dell’esercizio del diritto di recesso.

CLAUSOLA RISOLUTIVA ESPRESSA
In caso di mancato pagamento totale o parziale del prezzo di acquisto del bene Toscana Art Connection s.r.l. si riserva il diritto di dichiarare ai sensi e per gli effetti dell’art. 1456 del codice civile risolto il presente contratto mediante l’invio di una comunicazione scritta all’indirizzo elettronico del cliente.

RECLAMI
Per ogni eventuale reclamo o chiarimento, il cliente dovrà contattare il numero +39 3451581209 o l’indirizzo di e-mail: info@nousartgallery.it. Il cliente verrà ricontattato per chiarimenti entro 3 (tre) giorni lavorativi dalla richiesta.

LEGGE APPLICABILE E FORO COMPETENTE
Il presente contratto è regolato dalla legge italiana. La competenza e il foro esclusivo per ogni eventuale azione legale intentata dall’Acquirente ai sensi della presente garanzia o di eventuali ulteriori garanzie legali sarà il Tribunale di Firenze. In caso di vittoria Toscana Art Connection s.r.l. in un’eventuale azione legale, l’attore dovrà rimborsare a Toscana Art Connection s.r.l. le spese, comprese le parcelle degli avvocati e le spese del giudizio, sostenute da Toscana Art Connection s.r.l. per la propria difesa.

RINVIO
Per quanto non espressamente previsto nel presente contratto si applicano le norme di legge italiana vigente.

GENERAL INFORMATION

These General Terms and Conditions of Sale concern the purchase of products marketed by Nous Art Gallery, Toscana Art Connection s.r.l. carried out remotely via an electronic network on the internet site www.nousartgallery.it, located in San Gimignano (SI), Via Cellolese, 3 / d. Each purchase transaction will be governed by the provisions of Legislative Decree. 185/99, Legislative Decree. 206/05; the information directed at the conclusion of the contract will be submitted to the art. 12 of the Legislative Decree. 70/03 and, as regards the protection of confidentiality, will be subject to the legislation referred to in Legislative Decree. 196/03.

CONCLUSION OF THE CONTRACT AND ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE
Contracts for the sale of products on the site www.nousartgallery.it, are considered concluded when the purchase order made by the customer to Toscana Art Connection s.r.l. and the latter accepts it. Toscana Art Connection s.r.l. promptly send the customer receipt of the purchase order made by the customer.
The customer, with the electronic submission of his purchase order, declares to have read and accepted these general conditions and is obliged to observe and respect them in its relations with Toscana Art Connection s.r.l.

TREATMENT OF PERSONAL DATA
Toscana Art Connection s.r.l. pursuant to art. 13 of Legislative Decree 196/2003 informs that personal data and tax records also acquired verbally in reference to the established commercial relationships, provided directly by the interested parties, or otherwise acquired within the company’s activities, will be processed in compliance with the aforementioned legislation , including the confidentiality obligations set by them.
In relation to the aforementioned, the rights referred to in Article 7 of the Legislative Decree may be exercised. 196/2003.

CUSTOMER OBLIGATIONS
Before sending the purchase order, the Customer must carefully read these general conditions of sale. The forwarding of the purchase order implies their full knowledge and acceptance.
Finally, once the online purchase procedure has been completed, the Customer is obliged to print and keep these general sales conditions, already viewed and accepted during the conclusion of the contract.

DEFINITION OF THE ORDER
By sending the order online, the Customer transmits to Toscana Art Connection s.r.l. a proposal to purchase the product and / or products included in the cart. When the Customer places an order online for the products he has placed in the cart, he agrees to purchase them at the price and terms indicated in these General Conditions of Sale.

Toscana Art Connection s.r.l. will communicate to the Customer the acceptance and confirmation of the order.
In particular Toscana Art Connection s.r.l. will not accept orders:
– if the material, when ordering was not available in stock and / or
– if the customer can not or does not want to pay using credit cards (Paypal) or bank transfer.
It is possible to place an order both through the www.nousartgallery.it website at the prices and conditions indicated in the same and at the Nous Art Gallery offices.

MODALITY OF PURCHASE
The customer purchases the product, whose characteristics are illustrated on-line in the relative descriptive and technical sheets, at the price indicated therein, plus the delivery costs specified on the website. (any costs for cash on delivery are excluded).
Before the purchase order is sent, the unit cost of each selected product is summarized, along with the total cost for the purchase of several products and the related delivery costs.
Once the purchase order has been submitted, the customer will receive from Toscana Art Connection s.r.l. an e-mail message confirming receipt of the purchase order and containing information on the main characteristics of the purchased good, detailed indication of the price, delivery costs, applicable taxes and means of payment and containing a reference to the general conditions of contract and to information on the existence of the right of withdrawal, on the terms and conditions of its exercise displayed on the site. Following the approval of the Decree Law of 4 July 2006 no. 223 “bis maneuver” Art. 37 paragraphs 8 and 9, converted with Law 248 of 4 August 2006, entered into force on 12 August 2006, which reinstates the obligation to communicate the list of customers and suppliers in case of issue invoice, and Decree Law 78 of May 31, 2010 converted into Law 122 of July 30, 2010, requires the need to require customers to communicate VAT and TAX CODE in the appropriate fields on the site.

PAYMENT
The customer can make the payment due by choosing one of the following methods listed.

Payment by credit card: In the event that the consumer intends to make the payment by credit card, he can use the payment procedure with PayPal, suitable to ensure the confidentiality of data provided by customers. For any further information and legal agreements, please refer the customer to www.paypal.com. We also accept payments by bank transfer.

DELIVERY 
The purchased good, together with the related invoice, is delivered by courier to the address specified by the Customer when ordering online. Any specific needs must be presented by the client to Toscana Art Connection s.r.l.
Toscana Art Connection s.r.l. guarantees the delivery of the goods within 15 (fifteen) working days from the date of receipt of the confirmation of the transaction. (For payment by cash on delivery the 20 days will be counted from the date of receipt of the order by e-mail.). In the event that the customer chooses the method of delivery on delivery, payment must be made exclusively through cash or cashier’s check, to be delivered directly to the courier upon receipt of the goods.
If Toscana Art Connection s.r.l., could not guarantee delivery within the aforementioned terms, an additional 10% discount will be applied to the total cost of the items taken care of by Toscana Art Connection s.r.l. of reference.
In the case of non-delivery due to the absence of the recipient, to the address indicated by him in the order, the courier will leave a notice and try again a second time; if the recipient is still absent, the goods will be returned to the sender.

CONFORMITY GUARANTEE
The products purchased on the site www.nousartgallery.it are subject to the discipline on the sale of consumer goods. The delivered products comply with the characteristics illustrated on-line in the relative descriptive and technical sheets.

RIGHT OF WITHDRAWAL
The consumer has the right to exercise the right of withdrawal. In particular, the consumer has the right to withdraw from any contract concluded with Toscana Art Connection s.r.l., without any penalty and without specifying the reason, within the term of 14 (fourteen) working days from the receipt of the goods.
The right of withdrawal is recognized by the consumer in relation to any goods purchased by him on the site www.nousartgallery.it.

METHODS FOR THE EXERCISE OF THE RIGHT OF WITHDRAWAL
The right of withdrawal is exercised by sending, within the aforementioned term, a written notice to the address of Toscana Art Connection s.r.l. by registered letter with acknowledgment of receipt.
In case of exercise of the right of withdrawal, the communication must be made to the following address:

If the goods have been delivered, the customer is required to return it to Toscana Art Connection s.r.l. within the term of 15 (fifteen) working days from the date of delivery of the goods.
The property must be returned to Toscana Art Connection s.r.l. complete with every accessory, instruction manuals and everything originally delivered to the customer, as well as packed in its original wraps. A copy of the electronic receipt of the order must be attached to the returned product. The costs of returning the goods to Toscana Art Connection s.r.l. they are charged to the customer.
If the right of withdrawal is exercised by the customer in accordance with the provisions contained in this clause, Toscana Art Connection s.r.l. is required to reimburse the sums paid by the customer.
In particular, Toscana Art Connection s.r.l. will proceed free of charge to the transmission of the re-credit order related to the cost of the goods shipped including shipping costs within 30 (thirty) days from the date on which it became aware of the right of withdrawal by the customer. This operation will be carried out through the credit institution issuing the credit card used for payment or by crediting the sum to the bank account indicated by the customer.
Toscana Art Connection s.r.l. has the right to reject any product returned in a manner other than those specified above, as well as products for which the return costs have not been fully paid by the customer, or the methods and times indicated for communication of the product have not been respected exercise of the right of withdrawal.

EXPRESS RESOLVED CLAUSE
In case of non-payment of all or part of the purchase price of the item Toscana Art Connection s.r.l. reserves the right to declare pursuant to and for the purposes of art. 1456 of the civil code resolved this contract by sending a written communication to the customer’s electronic address.

APPLICABLE LAW AND JURISDICTION
This contract is regulated by the Italian law. The jurisdiction and exclusive forum for any legal action brought by the Purchaser under this warranty or any additional legal guarantees will be the Court of Florence. In case of victory Toscana Art Connection s.r.l. in an eventual legal action, the plaintiff must reimburse Toscana Art Connection s.r.l. expenses, including attorney fees and court fees, incurred by Toscana Art Connection s.r.l. for their defense.

POSTPONEMENT
For anything not expressly provided for in this contract, the provisions of Italian law in force apply.
